Guns and no Roses
Robert L and his wife were undergoing a contentious divorce. On July 20, 2006, Robert’s wife called the police and claimed that Robert pointed a gun at her when he couldn’t make entry into the home due to her changing the locks. Robert would eventually be arrested and charged with aggravated domestic assault with a firearm, for which he was facing a minimum mandatory of 10 years in Florida state prison.
My investigator went to the incident location, took pictures, and spoke to the wife’s neighbors. At trial, I was able to show that despite the wife’s claims about Robert shouting and causing a disturbance, not one of her neighbors who were within twenty feet, heard or saw anything described by the wife. Through aggressive cross-examination, I was able to establish numerous inconsistencies in the wife’s statements. The jury found that the state did not prove their case and acquitted Robert.
