The father-in-law of Lucius S. called 911 and claimed that Lucius pointed a gun and threatened to shoot his son after an argument.  Lucius was arrested and charged with aggravated assault with a firearm.  Because of the firearm and his extensive prior criminal record, Lucius was offered 10 years in prison without any good time off.

At trial, I argued that Lucius and his wife’s brother had a long standing feud, and that the brother’s statements were contrived to get Lucius arrested and imprisoned.  I was able to get the father to admit that he never saw a gun and was only repeating what his son told him.  Lucius’ wife testified and explained the feud between her brother and Lucius.   She stated that there was only an argument – no gun.  It took the jury some time, but they eventually found Lucius Not Guilty.
